Peña Aleczander represented a Texas equipment-sales company and its owner in a Texas state court lawsuit brought by an equipment-finance lender over a group of equipment financing agreements and related personal guaranties. The matter was resolved by agreement of the parties on the eve of trial.

In its petition, the lender claimed the company had defaulted on payments under several financing agreements and that the owner was personally responsible under guaranties he had signed. The lender sought the accelerated unpaid balance, interest, attorney’s fees, and a judgment against the company and its owner jointly.

In their court filings, the company and its owner denied the lender’s claims, raised defenses under the Texas Business and Commerce Code concerning the lender’s handling and disposition of equipment, and asserted counterclaims of their own. Shortly before the scheduled jury trial, the parties reached an agreed resolution of all claims and counterclaims, bringing the litigation to an orderly close to the benefit of all parties.
